SB14 Hazardous Waste Source Reduction

Listed on the DTSC Pollution Prevention webpage are industry-specific assessments of hazardous waste source reduction, which were undertaken by DTSC for the SB 14 program.  As indicated on the listing, some are completed and currently available online for reference by generators.

These assessments describe successful source reduction technology implemented by specific industry sectors in California. The technology is applicable to generators in the specified industry, or in other industries, for planning SB 14 hazardous waste source reduction programs.

Senate Bill 14 is the Hazardous Waste Source Reduction and Management Review Act of 1989.  SB 14 requires hazardous waste generators to seriously consider source reduction as the preferred method of managing hazardous waste. Source reduction is preferable over recycling and treatment options because source reduction avoids waste generation costs and management liability. Source reduction also provides the best protection for public health and the environment.

SB 14 requires that you prepare the three SB 14 documents, but only if you routinely generated more than 12,000 kilograms of hazardous waste or 12 kilograms of extremely hazardous waste in 2006. This requirement recurs every four years.  The Guidance Manual Chapter 1 has details.

You must include both the federal RCRA hazardous waste and the non-RCRA California-only hazardous waste, when adding up how much waste you routinely generated in 2006. The Guidance Manual Chapter 2 has details about which wastes to include and which wastes to exclude.

Hazardous waste generators subject to SB14 requirements must prepare the following three SB 14 documents by September 1, 2007:

(1) Source Reduction Evaluation Review and Plan. Or, if you meet the SB 14 criteria for a small business, you may prepare the Compliance Checklist instead.

(2) Hazardous Waste Management Performance Report. Or, if you meet the SB 14 criteria for a small business, you may use your most recent biennial generator report (BGR) as your Performance Report.  Section 66262.41 of the California Code of Regulations specifies the requirements for generators who must prepare the BGR.

(3) Summary Progress Report (SPR). Of these three documents, only the SPR must be submitted to DTSC by September 1, 2007. Submittal details are provided below.

All three SB 14 documents (or a copy of each) must be kept available on the facility site for an inspector to review.

The Summary Progress Report (SPR) must be submitted or sent to DTSC by September 1, 2007. It can be submitted online, or it can be sent by e-mail, or it can be sent by U.S. Postal Service mail. The SPR form includes instructions.

The Plan and Performance Report need not be sent to DTSC, unless expressly requested to do so by DTSC

• Guidance Manual:  This version of the SB 14 Guidance Manual is for the 2006 Reporting Year.

Chapter 5 of the Guidance Manual has detailed instructions for preparing the SB 14 Plan.

Chapter 6 of the Guidance Manual has detailed instructions for preparing the SB 14 Performance Report.

Chapter 7 of the Guidance Manual has detailed instructions for preparing and submitting the Summary Progress Report.

• Compliance Checklist: Only hazardous waste generators who qualify as a small business can complete the Compliance Checklist instead of preparing the Source Reduction Evaluation Review and Plan.   The Guidance Manual Chapter 4 has details.

This version of the SB 14 Compliance Checklist is for the 2006 Reporting Year. It can be used by a hazardous waste generator who qualifies as a small business by SB 14 criteria. Alternatively, the small business can choose to prepare the full SB14 Source Reduction Evaluation Review and Plan instead.

Section 7 of the Compliance Checklist has detailed instructions for preparing and submitting the Summary Progress Report.

• SB 14 Summary Progress Report (SPR) Online Reporting Form: The secured online reporting form is now available for your 2006 SPR.  DTSC prefers that you use this online reporting form. Your SPR must be submitted to DTSC by September 1, 2007.

• SB 14 Summary Progress Report (SPR) Excel Reporting Form: If you choose to not submit your report on-line, you may download and complete the 2006 Excel reporting form and submit it to DTSC by September 1, 2007.
